What is pre-trial detention?

Detention ordered while the case is being investigated, before there is any judgment.

It may be renewed in stages, which makes each hearing an opportunity to seek release.

What do we do?

We attend the hearings, challenge the reasons given for detention and argue for release or for conditions in its place.

We also work with the family to show stable residence and ties.

What affects the outcome?

The offence, the evidence, the risk of absconding and the person's circumstances.

We prepare the supporting documents before each hearing.

What should I do first?

  1. Note each hearing date

Detention is reviewed at set points.

  2. Collect proof of residence and ties

Lease, employment letter and family details.

  3. Prepare a guarantor if possible

Someone who can stand behind the person.

  4. Avoid contact with the complainant

It can be used against a request for release.

Frequently asked questions

How long can pre-trial detention last?

The law sets limits and stages. The overview of the criminal process sets out the periods, and we apply them to your case.

Is release always refused after the first order?

No. Circumstances change, and fresh applications may succeed.
